HORRY COUNTY, S.C. (WPDE) — Eric Poston says he's putting the final pieces of his lawsuit together on the Moorer's behalf.
He's going after the Solicitor's Office, Horry County Police and Facebook for harassment.
He says both Horry County Police and the Solicitor's Office know exactly who is to blame for Elvis's disappearance.
"It's one heck of a tale, you know, I think it's a better story than the 'Making of a Murderer' situation on Netflix that everyone's seeing. It's really just an incredible situation," said Poston.
Poston said in FaceTime call Monday that he has never before seen evidence that proves Sidney and Tammy Moorer had nothing to do with the disappearance of Heather Elvis.
"We've got a lot of audio, video and written transcripts that did not come out at trial. We've gotten many gigabytes of phone records that were not presented at trial," said Poston.
It's evidence he said Horry County Police know all about.
"The only people that have seen this evidence are the Solicitor's Office, the criminal defense attorneys and then expert witnesses have seen, you know, select pieces of the evidence," said Poston.
Poston says there are several people involved in Elvis's disappearance that are tied to police.
"These people are friends with the police; very, very, close friends with some of these main officers who were involved in Heather's disappearance. Extremely close connections," said Poston.
Tammy Moorer took the witness stand during her kidnapping trial, so we asked Poston why she didn't mention any of this alleged new evidence on the stand.
"We had to reach far beyond anything that Tammy and Sidney are knowledgeable about because they don't know what happened," said Poston.
ABC15's Deevon Rahming asked Poston in a Facetime call, "Do you know where Heather's body is?" He laughed and replied, "Well possibly, the problem with answering that question is we don't want it moved, we don't want it tampered with if there is a body somewhere."
Poston says all of the answers will come out in the lawsuit at the end of June when it's filed.
He says this isn't about Tammy or Sidney versus Heather. It's about getting the wrong people out of jail and the right people in.
Heather's mother Debbie says they were blindsided by this lawsuit and are waiting to see what evidence will be mentioned in it.
The Horry County Police Department said they don't comment on pending litigation.
The Solicitor's Office is under a gag order.
