CHARLESTON, SC (WMBF) – The attorneys on both sides of Sidney Moorer’s kidnapping case discussed possible dates for a retrial after his original trial ended in a hung jury in 2016.
During a status hearing held Friday in a Charleston County courtroom, defense attorney James Galmore asked that the court not schedule the trial for at least one year.
Solicitor Nancy Livesay said the state is ready to try the case now, as much of the same evidence that was presented in Tammy Moorer’s kidnapping trial from last fall will be used in this one.
Livesay requested the trial happen sometime after April, noting it’s one of the solicitor’s office’s oldest cases.
Judge Markley Dennis asked both sides to look at their calendars for the fall, saying there could be availability in August to try the case. He added it’s important that the families on both sides see the court proceedings finally come to an end.
“They need to have some closure too, and that’s important to me,” Dennis said.
A mistrial was declared in Sidney Moorer’s 2016 kidnapping trial in connection with the 2013 disappearance of Heather Elvis. A second trial is set to take place in Georgetown County.
His wife, Tammy Moorer, was convicted in October 2018 of kidnapping in reference to Elvis' disappearance and sentenced to 30 years in prison.
Sidney Moorer last appeared in court in December in Horry County, where he and Tammy Moorer were required to submit handwriting samples in a case in which the two are accused of making false statements on applications for Medicaid assistance and obtaining property through Medicaid under false pretense.
In November 2018, a parole board denied Sidney Moorer’s request for early release from prison. In August 2017, he was sentenced to 10 years after a jury found him guilty of obstruction of justice for impeding the investigation into Elvis' disappearance.
