MIDWEST CITY, Okla (KOKH) - Police are investigating after a 4-year-old said she was raped by a man in a McDonald's bathroom during a day care center field trip July 16.
Brandon Clables, the Midwest City police chief told Fox 25, "Apparently he had gone inside the bathroom where the little girl was, and at that point he had molested the child." 
Day care employees told police a 4-year-old girl had gone to the bathroom in the play area of McDonald's on the 7000 block of SE 15th St.
The care-takers said they noticed the girl was gone for a while and went to check on her in the bathroom, according to police.
They said they knocked on the door and it took a while but a man, identified as 37-year-old Joshua Kabatra, opened the bathroom door and walked out with his hands up and said "I was just washing my hands."
Care-takers told police they talked with the girl and asked if Kabatra touched her and she said yes. They then had the girl show them where Kabatra touched her and she pointed to her vagina.
Kabatra told police he was in the playground area when he started to feel sick so he went to the bathroom and opened the door, he said he noticed the girl, then threw up in the sink.
He then washed his hands and left the bathroom Kabatra told police.
Police spoke with the 4-year-old and asked her what happened; she told police Kabatra touched her with vagina with his penis and said he put his fingers inside her and asked her to touch his penis.
Kabatra was arrested for lewd acts with a child and rape.
"It's a horrific case. It's a case where there's the opportunity, the desire and ability to commit the crime," Clables said. 
McDonald's has released this statement in the wake of this incident:
At McDonald’s, nothing is more important to us than the safety and well-being of our customers. We are deeply disturbed by the incident that occurred at one of our Oklahoma restaurants earlier this week. We are fully cooperating with the police during their investigation. At this time, our thoughts are with the victim and others impacted by this incident.
