CONWAY, SC (WBTW) – Prosecutors want a judge to decide whether Sidney Moorer violated a gag order when he talked to News13 during his trial last month, according to court documents filed Monday.
Moorer is charged with the kidnapping of Heather Elvis; she disappeared in December 2013 and hasn’t been seen since. A judge issued an order in March 2014 preventing Moorer and the State from talking about the case.
Moorer reached out to News13 after prosecutors presented surveillance video showing him buying a pregnancy test on the night Elvis disappeared. Prosecutors suggested throughout the trial that Moorer kidnapped Elvis because she was pregnant.
“I was actually buying it for my wife. She was in the vehicle when I bought it for her. She took it that night, and it was negative, like so many before and after,” Moorer said during the interview.
The judge declared a mistrial three days later after jurors said they couldn’t agree on a verdict. A date for a new trial hasn’t been set.
Prosecutors wrote in a motion filed Monday, “The State believes that the contents of the Defendant’s statement to this news outlet violated the terms [of the order].”
A hearing to determine whether Moorer violated the order has been set for September 6 at 9:45 a.m.
