Murder Trial for Both Sidney and Tammy Moorer Has Been Set for May 11, 2015

Sidney Moorer's defense attorney, Kirk Truslow, is requesting a second bond hearing for Sidney Moorer. The motion suggests the defense has found the state's evidence contradicts what put Sidney behind bars in the first place.
"I noticed by looking at Mr. Truslow's motion that he is basically setting forth that there are things presented at the initial bond hearing that upon his review of the discovery, are inaccurate," Billy Monckton said.
Monckton is the Managing Partner at Monckton, Hembree, Mureddu, and Humphries P.A.
Billy Monckton has been practicing law for 22 years.The former prosecutor says it's typical for the defense to file repeated requests for bond especially since Sidney has been in jail for almost a year now with his wife Tammy, charged with Heather Elvis' murder, but he says this motion could be different.
"In my opinion, it could hurt the state's case, if they've presented inaccurate information to the judge already," Monckton added.
With a high profile case like this, Monckton explains, this won't be the last motion we see.
"There will be motions regarding evidence that will be filed. There will be motions to exclude evidence. There may be motions to exclude witnesses," Monckton explained.
The gag order limits much of what could be coming next, but a court order, reveals the county will be screening 800 jurors and Monckton says jurors will not be disqualified just because they know about the case.
"You're only to base your decision, only on the evidence presented in the courtroom, not what you hear on a blog, not what you see on T.V. Its only what's in the court room and if you can do that, the judge will put you on the panel," Monckton said.
Monckton says any potential defense motion to move the trial out of Horry County can't happen until they try to seat a jury.
"Not knowing what happened to Ms. Elvis is going to be a big burden on the state in this case," Monckton explained.
For the defense, Monckton says they will have to dig through everything and anything.
"Is there another story, is somebody a tip provider on somebody that wasn't investigated that makes more sense," Monckton said.
Monckton says both sides will have to sift through hundreds of witnesses and social media outlets.
"That's a lot of work from both the state and the defense, because you don't know what's in there, because we don't, nobody knows for certain what happened here," Monckton added.
In a statement from Heather's father, Terry, he too just wants to know what happened, and where Heather is, but says he is confident the people and residents of Horry County will dispense justice.
